Phantom Screens Limited Lifetime Warranty

Terms & Conditions:

Phantom Mfg. (Int’l) Ltd. warrants solely to the original purchaser of Phantom Screens that the screen purchased shall be free from defects in materials and workmanship under normal use as long as the screen remains at its installed location and is owned by the original purchaser. This Limited Warranty does not apply to: (a) mesh and mesh components; (b) clear and colored vinyl materials; (c) asserted defects caused by modification, misuse, or abuse, or improper maintenance of the screen; (d) asserted defects involving subjective personal likes or judgments; (e) defects asserted by any purchaser who did not purchase the screen from an Authorized Phantom Distributor or Dealer in the United States of America or Canada; (f) specific components as outlined below:


Motors and manual gears: Phantom Mfg. (Int’l) Ltd. warrants the electrical motors and manual gears for a period of five years, commencing from the date of satisfactory installation for the original purchaser, against failure under expected normal use. Warranty is void if the electrical motor is exposed to water, acts of God or abnormal conditions.


Electrical and electrical accessories: Phantom Mfg. (Int’l) Ltd. warrants the electric components, including remote transmitters and receivers for a period of five years, commencing from the date of satisfactory installation for the original purchaser, against failure under expected normal use. This warranty is void if the electrical components are exposed to water, acts of God or abnormal conditions. The costs of removal, shipping and installation of the included materials are under warranty for a period of two years from the date of original installation by an Authorized Phantom Distributor or Dealer.

Limitation on Obligation

The obligations of Phantom Mfg. (Int’l) Ltd. hereunder are limited to repair or replacement (at our sole option) of included parts of the screen found to be defective under this Limited Warranty. In no event shall Phantom Mfg. (Int’l) Ltd. be liable for damages of any type, including, but not limited to: economic loss; or any indirect, punitive, special, incidental, or consequential damages of any type, including, but not limited to, time, wages or lost profits, of any nature or kind, or for damages to or loss of property, whether caused by negligence or otherwise. Any implied warranty, including, but not limited to, the implied warranty of merchantability and the implied warranty of fitness for a particular purpose, is hereby limited in duration to that of the express limited warranty contained in this document, unless a shorter period is permitted by law. This document sets forth the entire liability of Phantom Mfg. (Int’l) Ltd. with respect to Phantom Professional screens, Legacy screens, Serene screens, Prestige screens, Executive screens and Distinction screens. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

No Other Express Warranty

The Limited Warranty set forth herein constitutes the entire express warranty and representation of Phantom Mfg. (Int’l) Ltd. with regard to its screen products. This Limited Warranty shall be controlling over any conflicting terms and conditions of any purchase orders, contracts or invoices which may be executed in connection with the purchase of Phantom Screens products. No representation or warranty made by any Phantom distributor, dealer, agent, representative or employee shall be binding to you or Phantom Mfg. (Int’l) Ltd. other than as set forth herein.

Who Is Entitled To This Warranty?

This Warranty applies only to the original purchaser who paid for the product and may not be assigned or transferred to subsequent owners. This Warranty applies only to products purchased and installed in the US by Authorized SunPro Motorized Awnings & Screens Dealers.

What are the responsibilities of SunPro Awning under this warranty?

Subject to the terms and conditions set forth herein, SunPro Motorized Awnings & Screens will furnish replacements for parts found by SunPro Motorized Awnings & Screens to be defective in design, manufacture or assembly, under each specific component or product warranty as set forth below.

Who Can Make Claims Under This Warranty?

1. Before any claims may be made under this Warranty, the original purchaser must have paid in full for the product covered under the Warranty, according to the terms and conditions in the original order. The purchaser agrees and acknowledges that this Warranty agreement constitutes an executory contract.

2. The purchaser must use care in installation, maintenance, operation, use, and storage of the product in accordance with the FAQ (Frequently Asked Questions) & Product Use Guidelines.

ANY FAILURE TO INSTALL, MAINTAIN, OPERATE, USE AND STORE THE PRODUCT IN ACCORDANCE WITH THE INSTRUCTIONS WILL NULLIFY THIS WARRANTY AND RELIEVE SUNPRO AWNING FROM ANY RESPONSIBILITY OR LIABILITY UNDER THIS WARRANTY.

3. Promptly notify SunPro Motorized Awnings & Screens of any claims.

4. The purchaser may be required to provide a photograph of any defective parts. The purchaser may also be required to pay a deposit until the defective parts are returned to SunPro for inspection. The purchaser must obtain a return authorization form from SunPro Awning customer service department prior to the return of any merchandise and after having received such authorization, return the part or product, freight prepaid, to SunPro Motorized Awnings & Screens.

What Is Covered Under Warranty

1. The following components of the SunPro Awning are covered under this Warranty, subject to the limitations set forth below. These components have a ten (10) year limited warranty, against manufacturer's defects as outlinedbelow: (a) Should the purchaser promptly notify SunPro Motorized Awnings & Screens of such defects within ten years (120 months) from the date of the original purchase, the defective component will be replaced at no charge.

2. Covered Components:

STRUCTURAL SUPPORTS , which include the lateral arms, the square bar, the front bar and all other attached supports are warranted not to fail for ten (10) years provided that the components are not subjected to excessive winds or water pooling on the fabric.

ROLLER BAR is warranted for ten (10) years against any and all damage including cracking and permanent bowing that would affect the performance of the awning, provided that the awning is not subjected to excessive winds or water pooling on the fabric.

FABRIC is warranted for ten (10) years against:

(a) Excessive fading under normal conditions if maintained, operated, used, and stored in accordance with the Product Use Guidelines contained below.

(b) Mildew on the fabric. Mildew will not form on the fabric itself but may form on dirt and dust that have not been removed from it. Please see below - "Cleaning your Awning" for proper cleaning instructions.

(c) Excessive cracking or peeling under normal conditions if maintained, operated, used, and stored in accordance with the instructions contained in FAQ/ Guidelines below, and provided that the awning is not subjected to excessive winds or water pooling on the fabric.

ELECTRIC MOTOR is warranted for ten (10) years not to fail under normal conditions.

AWNING ACCESSORIES (defined as accessories attached to the awning) are warranted for (24) months not to fail under normal conditions.

What Is NOT Covered Under Warranty

1. SunPro Motorized Awnings & Screens awnings are not designed to be used for carports and are not designed to be installed on moving vehicles. Any damage that results from the Purchaser's use of SunProAwning awnings for carports or on moving vehicles is not covered by thiswarranty.

2. Any failure or damage of the components that results from any intentional or negligent actions by the purchaser or by any other person is not covered by this Warranty.

3. It is the responsibility of the purchaser or selected contractor to securely fasten the awning to studs, joists, headers or other structural members. Any failure or damage that results from the awning falling from its installed position is not covered by this Warranty.

4. Labor charges connected with installation of replacement parts are not covered by this Warranty.

5. Freight expenses to and from SunPro Motorized Awnings & Screens for any replacement parts are not covered by this warranty and must be paid by the purchaser.

6. Stretching of fabric or damage to any structural component caused by wind or water pooling on the fabric or any other weather are not covered by this Warranty.

7. Tears or rips caused by failure to protect the product from sharp objects are not covered by this Warranty.

8. Wind damage due to leaving awning rolled out during foul weather are not covered under this Warranty.

9. Fabric discoloration or failure due to chemical exposure (includes tree sap, bird droppings, leaves, insect/Bee sprays and or debris.) are not covered under this Warranty.

10. Valance damage if left out thru winter months or from storm damage such as hail are not covered under this warranty. All Valances should be removed from front bar and stored for anyoff-season.

11. Mildew caused by dirt resting on the product, or the product being rolled up while wet are not covered by this Warranty.

12. Damage caused by acts of God.

13. Any modification or addition to the awning structure and support system or to the electric motor or its wiring will nullify this Warranty and relieve SunPro Motorized Awnings & Screens from any responsibility or liability under this Warranty.

General Provisions & Limitations

1. THE WARRANTY GRANTED HEREIN IS THE EXCLUSIVE REMEDY FOR THE PURCHASER. SUNPRO MOTORIZED AWNINGS & SCREENS MAKES NO OTHER WARRANTIES TO THE PURCHASER, EXPRESS, STATUTORY, IMPLIED OR OTHERWISE AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATIONS, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED.

2. TO THE EXTENT PERMITTED BY LAW, SUNPRO MOTORIZED AWNINGS & SCREENS SHALL HAVE NO LIABILITY TO THE PURCHASER OR ANY OTHER PERSON FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES OF ANY KIND OR NATURE WHATSOEVER, WHETHER ARISING OUT OF BREACH OF WARRANTY OR OTHERBREACH OF CONTRACT, NEGLIGENCE OR OTHER TORT, OR OTHERWISE, EVEN IF SUNPRO MOTORIZED AWNINGS & SCREENS SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH POTENTIAL LOSS OR DAMAGE. IN NO EVENT SHALL SUNPRO MOTORIZED AWNINGS & SCREENS BE LIABLE FOR LOSS OF PROFITS AND/OR WAGES.

3. Some states do not allow limitations on how long an implied warranty lasts, or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

4. This warranty gives you specific rights, and you may have other rights, which vary from state to state.

QMI Warranty

Limited Warranty

QMI Security Solutions (“QMI”) provides the following limited warranties for its products, when properly maintained and under normal use and service, which warranties begin to run from the date of delivery as identified on QMI’s invoice. Before installing, customer or third-party shall determine the suitability of product for its intended use. QMI is not responsible for material failure due to inadequate or faulty installation unless QMI provided the installation. If there is a defect in the warranted product, QMI or any of its authorized dealers will remedy the defect pursuant to the terms of this limited warranty. At the sole option of QMI, the remedy shall consist of (a) repair or replacement of the warranted product, at a cost to you as shown in the coverage period table herein, or (b) refund of the actual price paid for the defective product. The warranty does not cover any costs for demolition or repair to service the shutter when the shutters are built-in or not fully accessible. No scaffolding or specialty equipment shall be provided under warranty services.

Coverage Period

One Year: All Parts & Labor. No costs for parts and no cost for labor if QMI provided original installation

Two Years: Electrical accessories and low voltage drive system (EZ motor only). No cost to you for material.

Five Years: Slat/blade finish. Slats: You pay 25% of retail list price for materials.

Five Years: Alternating current (A/C) electric motors (std and Hz motors). You pay a $25 handling fee (new motor furnished only-warranty period does NOT start over)

Limitation of Warranty

THERE IS NO EXPRESS OR IMPLIED WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND (INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR USE) EXCEPT FOR THE EXPRESS WARRANTY IN PARAGRAPHS 1 AND 2 OF THIS LIMITED WARRANTY. In the event that applicable consumer law prohibits the disclaimer of an implied warranty, the above Limited Warranty shall not extend the time period of any such implied warranty. Some states do not allow limitations for consumers on how long an implied warranty lasts, so the above limitation may not apply to you. This Limited Warranty gives you specific legal rights, and you may have additional rights, which vary from state to state.

Coastal Area Maintenance

The warranties listed in Paragraph 1 shall be the same for products in any “Coastal Area,” as defined in the QMI Rolling Shutter Maintenance-Coastal Warranty Requirements (“Coastal Requirements”), subject to the maintenance obligations in said Coastal Requirements, incorporated herein by reference. If QMI determines that the Purchaser failed to adhere to the required maintenance in the Coastal Requirements, all warranties stated herein shall be void.

Purchaser's Duty to Notify QMI

The Purchaser shall notify QMI in writing of any warranty claim within thirty (30) days after the Purchaser first discovers an alleged defect. Purchaser shall send written notice to QMI via electronic mail (e-mail) to warranty@qmiusa.com.

Exclusions

This warranty and all of QMI’s obligations stated herein shall NOT apply to:

  • Any warranted product that was altered or serviced by anyone other than the original authorized installer
  • Labor and materials required to install or repair the finishing or other materials that were applied to or adjacent to the warranted product after the initial installation
  • Labor and materials required to paint or stain any repaired or replaced product, component, trim, or other carpentry work
  • Products not manufactured by QMI
  • Minor sticking or minor warping. QMI or any of its authorized dealers may defer actions on any claim for sticking or warping for a period of up to twelve (12) months from the date of the claim in order to permit conditioning and equalization to humidity and temperature conditions
  • Minor scratches or other imperfections in the surface that do not impair structural integrity
  • Tarnish or corrosion to hardware finishes
  • Stress cracks
  • Service trips to provide instruction on product use
  • Applicable taxes and freight
  • Customer colors. Contact us concerning the limited warranty on custom colors
  • Slat/blade paint finish in coastal areas where wind borne particles (sand, tree debris, building materials, etc.) cause paint damage is NOT covered under warranty
  • Sand and salt accumulation in the slat/curtain hinges may affect shutter

Limitations of Damages

QMI SHALL NOT BE LIABLE TO PURCHASER FOR ANY EXEMPLARY, PROXIMATE, CONSEQUENTIAL OR INCIDENTAL DAMAGES, WHETHER ARISING UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHER THEORY IN LAW OR EQUITY. QMI’S MAXIMUM LIABILITY TO PURCHASER SHALL NOT EXCEED THE CONTRACT PRICE OF THE ORDER GIVING RISE TO THE CLAIM, DEMAND, OR CAUSE OF ACTION. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Limitation of Actions

Any action for any loss or damage with respect to the products or workmanship covered hereunder must be commenced by Purchaser within one year after Purchaser’s cause of action has accrued.

Entire Agreement

This Limited Warranty contains and represents the only warranty extended by QMI. No employee or agent of QMI or any other party is authorized to make any other warranty in addition to those made in this Limited Warranty.

No Oral Modification or Waiver

No modification of this warranty, or waiver of its terms, shall be binding on either party unless formally approved in writing by both parties.

Governing Law & Venue

This warranty, and the rights and duties of the parties under it, shall be governed by the laws of the State of Illinois. The parties agree that the exclusive venue for any action arising hereunder shall lie in the Eighteenth Judicial Circuit, DuPage County, Illinois.
